Terms and Conditions
These Terms and Conditions (“Terms”) govern your access to and use of CAG Moveflow (the “Service”), an application designed for property managers to organize move-ins and move-outs, capture photos, and compare property condition over time. By accessing or using the Service, you agree to be bound by these Terms.
1) The Service
- Purpose: Help property managers document unit condition at move-in and move-out, including photo capture, checklists, timestamps, and comparisons.
- Location Services: The app may request GPS location to verify where inspections or time-stamped photos were taken. GPS is required for some features to function correctly.
- Media Capture: Users can capture and upload photos (and related metadata) as part of the inspection process.
2) Accounts & Authorized Use
- You must provide accurate information and maintain the security of your credentials.
- You are responsible for all activity that occurs under your account.
- Do not misuse the Service, attempt to disrupt it, or access it using methods other than the provided interfaces.
- You must comply with all applicable laws, including those related to tenant communications, privacy, and fair housing.
3) Your Content & Rights
- Ownership: As between you and us, you own the photos, notes, and other content you upload (“User Content”).
- License to Us: You grant us a limited, non-exclusive license to host, process, and display User Content solely to provide and improve the Service.
- Responsibility: You are responsible for obtaining any permissions required to capture and store photos within occupied properties and for ensuring your use complies with lease, landlord-tenant, and privacy rules.
- Prohibited Content: Do not upload unlawful, offensive, or infringing content.
4) Location Data
- By enabling location, you consent to the collection and processing of GPS coordinates to validate inspections and photo events.
- You can disable location at the device level, but some features may not work as intended (e.g., location-verified inspections).
5) Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect information. Please review it carefully.
6) Availability & Changes
- The Service may evolve over time; features may be added, changed, or removed.
- We may suspend or terminate the Service (or your access) if you violate these Terms or for operational, security, or legal reasons.
7) Fees
If subscription or usage fees apply, they will be disclosed separately. You agree to pay any applicable charges and taxes associated with your use.
8) Disclaimers
- The Service is provided “as is” and “as available.” We do not warrant uninterrupted, error-free operation or that defects will be corrected.
- We are not responsible for the accuracy of User Content or for decisions you make based on outputs (e.g., damage charges, deposit withholdings).
9) Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Service.
10) Indemnification
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service, your User Content, or your violation of these Terms or applicable laws.
11) Intellectual Property
We retain all rights, title, and interest in and to the Service, including software, interfaces, and branding. These Terms do not grant any rights to use our trademarks, logos, or trade dress.
12) Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms. Upon termination, the license to your User Content for service operation ends, except where retention is required by law or for legitimate business purposes (e.g., backups for a limited period).
13) Governing Law
These Terms are governed by the laws of the state or jurisdiction where our principal operations are located, without regard to conflict of law principles.
14) Changes to These Terms
We may update these Terms from time to time. The “Effective Date” below indicates the latest revision. Continued use of the Service after changes means you accept the updated Terms.
